DATA PRIVACY

When you submit your art we will ask you for personal details such as your name, age and country. This information is only collected for the purposes of crediting your art and sharing the scope of submissions. If you are under the age of 18, we will ask for the email address and phone number of your parent/guardian which is only used for the purpose of confirming consent. We will never sell or rent your information to third parties. This information will only be available to Terre des Hommes Germany staff responsible for the call for art submissions. Once the call for art is over, parent/guardian contact information will be deleted from our database

INTELLECTUAL PROPERTY

The copyright in any submission shall remain the property of the participant, but entry in this submission call constitutes participant's irrevocable, perpetual permission and consent, without further compensation or attribution, to use the art submission and the participant's given name, age and country for educational, editorial, advertising, commercial and publicity purposes by Terre des Hommes Germany and/or others authorized by Terre des Hommes Germany, in any and all media now in existence or hereinafter created, throughout the world, for the duration of the copyright in the submission. Terre des Hommes Germany and/or others authorized by Terre des Hommes Germany have the right to edit, adapt, and modify the submission. Each participant releases and discharges Terre des Hommes Germany, all partners and any party associated with the development or administration of the submission call, their employees, agents or representatives or any of their parents, subsidiaries, sister companies, or affiliates from any and all liability in connection with the submission call, including without limitation, legal claims, costs, injuries, losses or damages, demand or actions of any kind.

 

GENERAL TERMS AND CONDITIONS

By participating, entrants agree to release, discharge and hold harmless Terre des Hommes Germany and their respective partners, affiliates, subsidiaries, agents, and their employees, officers, directors, and representatives, from any claims, losses, and damages arising out of their participation in this submission call.

As a condition of participating in this submission call, participants agree that any and all disputes which cannot be resolved between and among the parties, and causes of action arising out of or connected with this submission call shall be resolved individually, without resort to any form of class action. In any such dispute, under no circumstances shall any participant be entitled to claim punitive, incidental, or consequential damages, or any other damages, including attorneys' fees and all such parties hereby waive all rights to have damages multiplied or increased.

If, for any reason, the submission call is not capable of completion as planned, including by reason of fraud, act of God, or any other factor beyond Terre des Hommes Germany reasonable control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this submission call, Terre des Hommes Germany reserves the right at its sole discretion to cancel, terminate, modify or suspend the submission call without prior notice.

 

ADDITIONAL INFORMATION

By entering the submission call, participants accept the terms and conditions and confirm that they; are the copyright holders of the submitted art, and that no third party has any right or claim to the entry; grants the following non-exclusive rights in perpetuity to Terre des Hommes Germany; to store, copy, and make the art and concept available for all Terre des Hommes Germany regional offices worldwide on electronic equipment, CD-ROM, DVD or other similar media; the rights to use the art free of charge in any manner or purpose and sub-license the art to third parties for non commercial use.

Terre des Hommes Germany will credit the participant using their given name, age and country whenever possible when an art submission is used. Participants will hold Terre des Hommes Germany harmless from any breach of copyright.

Terre des Hommes Germany reserves the right to reject entries that we deem abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable. Entries must be suitable to be broadcasted, published or used online by Terre des Hommes Germany for audiences of all ages, but in particular for a young audience including children.

It is possible to revoke the consent given to Terre des Hommes Germany to make use of the submission at any time, without giving reasons. This will not affect the admissibility  of use up until the time of revocation. If consent is revoked, however, please note that we are entitled to use up printed matter for an appropriate transitional period.

As soon as Terre des Hommes Germany has received the revocation, it will no longer use and will delete the stored art submission. Even when it's been deleted from the terre des hommes websites and social media platforms they may still be visible on the websites of other providers. Terre des Hommes Germany has no direct influence on that. Art that has been used in print media will only remain in use until the printed edition has run out.

In the context of our justified interest and pursuant to Art. 6(1)1 f GDPR, the art may also be passed on to journalists for information about Terre des Hommes Germany, to document and report on our work, and to promote our aid interventions, development programmes, studies and campaigns for non-commercial purposes. You can revoke such usage at any time by email or a letter sent to the above address.

Terre des Hommes Germany will not be responsible for late, lost, illegible, or misdirected submissions, or for unauthorized human intervention, theft or destruction or unauthorized access to, or alteration of, entries. Terre des Hommes Germany is not responsible for any incorrect or inaccurate information, whether caused by any technical or human error, which may occur in the processing of entries in the submission call, including but not limited to any misprints or typographical errors.
